CANCELLATION.
Cancellation Policy, Statutory Model Cancellation Form, and Electronic Notice of Cancellation.

Withdrawal is not the same as cancellation. For distance sales, consumers may have a legal right to withdraw. However, there may be a legal exception for goods that are actually customized to meet individual specifications. Your rights depend on the specific contract.

1. Right of Withdrawal for Consumers
You have the right to cancel a contract that allows for cancellation within fourteen days without giving a reason.
The cancellation period is fourteen days from the day on which you, or a third party designated by you (other than the carrier), took possession of the goods. If multiple items from a single order are delivered separately, the period begins when you take possession of the last item.

You may use the sample withdrawal form below for this purpose, although its use is not mandatory.
To comply with the cancellation period, it is sufficient to send the notice of exercise of the right of cancellation before the cancellation period expires.
2. Consequences of the Revocation
If you cancel this contract, we must refund all payments we have received from you, including shipping costs (except for any additional costs resulting from your choice of a shipping method other than the least expensive standard shipping option we offer), without delay and no later than fourteen days from the day we receive notice of your cancellation.
We will use the same payment method for the refund as was used for the original transaction, unless otherwise expressly agreed; we do not charge any fees for the refund. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever comes first.
You must return or hand over the goods to us immediately, and no later than fourteen days from the date on which you notify us of your cancellation. The deadline is met if you ship the goods before the deadline expires.
Return Shipping Costs in the Case of a Statutory Right of Withdrawal: You are responsible for the direct costs of returning the goods. This applies only to the extent that you have a right of withdrawal under applicable law and no different cost-sharing arrangement is required by law.
Return of Items That Cannot Be Shipped as Standard Packages: Due to its dimensions, the roof box cannot typically be returned as a standard package. Our shipping provider, Excellence Global Logistics (EGL), has informed us that the return shipping costs are the same as those for the corresponding outbound shipment. Based on previous roof box shipments, we estimate the costs of a comparable return shipment to Unna for the following regions as indicated. These estimates are provided to consumers as approximate maximum costs and include the sales tax shown on the sample invoices, where applicable.
In the case of valid claims for defects, the statutory provisions regarding subsequent performance and the allocation of costs apply; this provision regarding rescission does not affect this.
You are only liable for any loss in value of the goods if such loss is attributable to handling that goes beyond what is necessary to assess the nature, characteristics, and functionality of the goods.
3. Exception for Genuine Custom-Made Products
Pursuant to Section 312g(2)(1) of the German Civil Code (BGB), the right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for which the consumer’s individual selection or specification is decisive for their manufacture, or that are clearly tailored to the consumer’s personal needs.
Important: The mere fact that a roof box is manufactured only after an order is placed, that a production deposit is paid, or that a standard catalog model is selected does not automatically result in the exclusion of the right of withdrawal. Whether the exception applies is determined based on the specific terms of the contract. We will inform you of any such exclusion before the contract is concluded.

5. Cancel the contract online
You can also submit a potential cancellation directly online. Please provide your name, an email address for confirmation of receipt, and information to identify the contract. Any additional information is optional.
Once your submission has been successfully sent electronically, you will receive a confirmation of receipt via email, including the date and time. Alternatively, you can send us a clear statement of withdrawal directly to freyberg@asphaltkind.de at any time.
