Terms and Conditions for ASPHALTKIND Products and Orders.

As of October 21, 2026

Contracting Party: Cropfiber GmbH, Hemmerder Wallgraben 15, 59427 Unna, Germany · Managing Director Nils Freyberg · freyberg@asphaltkind.de.

The ASPHALTKIND roof box is sometimes manufactured only after the order has been placed. The down payment does not constitute the full purchase price. The agreed-upon product details and the total prices specified for the specific order are what apply.

1. Scope and Customers

These General Terms and Conditions (GTC) apply to contracts for roof boxes, mounting systems, accessories, and custom-made products under the ASPHALTKIND brand that consumers (§ 13 BGB) or business entities (§ 14 BGB) enter into with Cropfiber GmbH. Individually negotiated agreements take precedence over these GTC. Conflicting terms and conditions from business entities are valid only with the express consent of Cropfiber GmbH.

2. Products, Features, and Compatibility

The type and scope of the service are determined by the model specified in the specific order process, the selected finish, the agreed-upon vehicle integration, and the confirmed special requests. Product images may differ from the actual appearance in individual cases; however, the agreed-upon characteristics remain binding.

The suitability of a roof box or roof rack system for a specific vehicle depends, in particular, on the model, year of manufacture, roof or fender design, and the requirements specified by the vehicle manufacturer. Vehicle compatibility that is not expressly confirmed does not constitute an agreement regarding quality. All prescribed safety, loading, and installation instructions must be followed.

3. Order, Conclusion of the Contract, and Customization

The product overview in the store is intended to assist with selection. Before a binding purchase is made, the product features relevant to the specific order, the total price including applicable taxes, and the shipping and additional costs must be displayed or agreed upon to the extent required by law.

A contract is formed through a clear order and its acceptance, or in accordance with the specific payment-based ordering process offered in each case. The €4,700 paid via PayPal constitutes a production deposit, not payment of the total price. A selection that is merely displayed in the price calculator is not automatically transferred to PayPal; the confirmed order is what counts.

Subsequent changes to the finish, color, accessories, or mounts may affect the price and delivery time and require an express agreement. Additional costs will not be charged unilaterally without a corresponding agreement.

4. Prices, Taxes, and International Orders

The website displays net prices and, for German residential customers, gross prices as well. The total consumer price applicable to the specific contract includes the value-added tax (VAT) required by law. The international tax calculator displayed on the website is for informational purposes only; the actual tax owed and agreed-upon shipping costs must be disclosed in accordance with legal requirements before a consumer places a binding order.

For deliveries to businesses within the European Union, a tax-exempt intra-Community supply may apply, provided the legal requirements are met. For exports to third countries, a German value-added tax exemption may apply if the required documentation is provided. Import value-added taxes, customs duties, and clearance fees in the recipient country may also apply; whether these are payable and by whom depends on the delivery terms agreed upon for the respective order.

5. Production Deposit and Final Payment

For the roof box configurations offered in the shop, the production deposit is 4,700.00 EUR. It can be paid using the available PayPal payment methods or, upon agreement, by bank transfer, and will be credited in full toward the purchase price. The remaining balance is generally due upon completion and before delivery or shipment, unless otherwise agreed upon in individual cases.

Production begins after a binding order agreement has been reached and the agreed-upon down payment has been received. Mandatory statutory consumer rights—including any applicable right of withdrawal and statutory refund claims—remain unaffected. The down payment is not definitively retained solely because production has begun.

6. Production and Delivery Dates

ASPHALTKIND products are handcrafted. Unless otherwise specified, delivery times are initially estimates; binding delivery dates remain binding. If the customer requests changes, a new delivery date may be agreed upon. Statutory rights regarding delivery delays remain unaffected.

7. Pickup, Shipping, Transfer of Risk, and Installation

Depending on the agreement, delivery will be made by pickup or shipping. The shipping method, delivery area, shipping costs, and any import requirements will be communicated and agreed upon to the necessary extent prior to the binding order. There is no entitlement to shipping to countries where delivery is legally prohibited; relevant sanctions and export regulations will be observed.

For consumers, the transfer of risk is governed by statutory provisions, in particular Section 474(2) of the German Civil Code (BGB); the risk of loss or damage in transit does not pass to the consumer merely because the goods are handed over to a carrier we have engaged. For business customers, the statutory provisions apply, in particular Sections 446 and 447 of the German Civil Code (BGB), to the extent permitted.

Installation and assembly are provided only to the extent that they have been expressly agreed upon. Assembly, loading, and safety instructions must be followed; this does not limit any statutory rights.

8. Retention of Title

Until the agreed-upon purchase price has been paid in full, the delivered goods remain the property of Cropfiber GmbH, to the extent permitted by law.

9. Rights in Case of Defects and Liability

Consumers are fully entitled to their statutory rights in the event of material defects or defects of title. Additional warranties apply only if they are expressly promised and their terms are provided. For businesses, the statutory obligations to inspect and give notice of defects apply, to the extent applicable.

We assume unlimited liability for willful misconduct and gross negligence, for injury to life, body, or health, and in accordance with mandatory statutory liability provisions, in particular the Product Liability Act. In all other respects, the statutory liability provisions apply; mandatory consumer rights are not excluded.

10. Right of Withdrawal for Consumers

Consumers generally have a statutory right of withdrawal for distance sales contracts, unless a statutory exception applies. For goods that are actually manufactured individually according to customer specifications or clearly tailored to personal needs, the exception under Section 312g(2)(1) of the German Civil Code (BGB) may apply. Mere production based on an order or the selection of standard variants does not automatically constitute grounds for exclusion.

In the event of a valid statutory cancellation, the consumer bears the direct costs of returning the goods, provided that the consumer was properly informed of this prior to the conclusion of the contract and no statutory exception applies. For a roof box that, due to its nature, cannot be sent by regular mail, the estimated return costs or a realistic maximum cost estimate will be provided prior to the conclusion of the contract.

Shipping Returns: Due to its dimensions, the roof box cannot typically be returned as a standard package. Our shipping provider, Excellence Global Logistics (EGL), has informed us that the return shipping costs are the same as those for the corresponding outbound shipment. Based on previous roof box shipments, we estimate the costs for a comparable return shipment to Unna from the following regions as indicated. These estimates are provided to consumers as approximate maximum costs and include the sales tax shown on the sample invoices, to the extent that it was applicable.

Poland (e.g., Gliwice)no more than about 700 €
Sweden (e.g., Jönköping)no more than about 820 €
Greece (e.g., Thessaloniki)no more than about 1,440 €
Northern Ireland (e.g., Bellaghy)no more than about 1,700 €
United States (e.g., Houston)no more than about 1,740 €

For other destination or pickup locations, remote addresses, or special shipping requirements, we will provide an estimate of the approximate maximum cost for the specific shipping route before a binding consumer order is placed. Additional customs and import regulations specific to returns from third countries must be taken into account. The amounts listed are not a flat-rate return price guarantee for any address. You may hire a suitable shipping provider yourself; pickup by EGL is not required.

In the event of a valid complaint regarding a defect, the statutory provisions regarding subsequent performance and the associated transportation costs apply. The amounts listed apply exclusively to a statutory right of withdrawal, not to the warranty.

You can find the applicable cancellation policy, information about exceptions, and the sample cancellation form on our cancellation page. Regardless of this, consumers may also clearly declare their intention to cancel by sending an email to freyberg@asphaltkind.de.

11. Governing Law and Dispute Resolution

German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. For consumers whose habitual residence is outside Germany, the mandatory protective provisions of their country of residence remain unaffected, to the extent that they apply under applicable private international law.

As things stand, Cropfiber GmbH is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board. Please verify this with the company’s decision before publication.

Should any individual provisions be invalid, the applicable statutory provisions shall take their place; the remaining clauses shall remain valid to the extent permitted by law.
